My friend who was discriminated against in a Chelsea branch of McDonald’s may or may not settler her case out of court. NYC Commission of Human Rights is trying to secure damages as well as compulsory diversity training at the offending branch.
But what about 34th st, the infamous Baltimore branch and the numerous other McDonald’s where LGBTQ people are being assaulted and discriminated against for trying to use the bathroom of their choice?
Time to create visibility around an issue that is bigger than McDonald’s, that is being fought on the floor of Congress.
If an international chain like McDonald’s overhauls its HR Policies and trains its people to prevent the proliferation of trans/homophobia, that’s 31,000 more safe spaces throughout the world where T-people and gender non-conformists can be themselves without discrimination or assault, despite what statutes/bills are passed.

There is a national and historical context surrounding the use of public restrooms. “As long as you do it in the privacy of your own home” won’t cut it when it comes to a basic biological need that everyone has and should be able to relieve with the same level of comfort. Yet, T-people are suffering from assault and a high rate of urinary-related health problems, because sometimes they don’t feel comfortable enough to use a public restroom and sometimes their fears are valid. Homophobia like racism takes root in law to make the dominant culture feel protected, and comfortable.
Is anyone really comfortable with this?
Someone recently wrote to us stating,
“In addition to discriminating against their transgender customers, McDonalds is poisoning them with their disgusting “food.” Read the book Fast Food Nation for some reasons why access to McDonalds should not be one of our movement’s top priorities. I would, however, get on board a campaign to educate LGBT consumers about healthier eating.”
I agree it’s not healthy. I don’t think I know anyone who eats there everyday. But people eat at McDonald’s and they always will. If you think this is about promoting fast food, you are missing the point. A major corporation is allowing its employees to discriminate against trans and gender non-conformist peoples- to spill teeth and blood on their branch floors. This is not about promoting McDonald’s food. It’s about promoting the safety of those who choose to still eat there and use their restrooms. Ever been in NYC and had to use the bathroom late at night and there was just a McDonald’s? In theory for a pack of fries or a bottle of water we should all be entitled to use their public restrooms in peace.
This will be great ground for our community to break in terms of securing the rights of T-people to use the public restroom of their choice. McDonald’s is a big deal and if they overhauled their HR Policies and worked with us on branch participation a lot of people/corporations would pay attention and possibly follow suit.

In order for this to work we need you and all of your friends. A successful spending campaign will take at least 1,000 people spending in unison at one McDonald’s branch to make them even think of integrating these changes. Help us create a base of conscious consumers who are aware of the context of public humiliation, discrimination and assault taking place at McDonald’s. We believe that we are in a position to make a change and hope that you stay committed to seeing this consumer activist campaign to fruition.
Talking Points
- Mobilization- ground team - everyone is ground team in the sense that you all should add as many people as you can to the FB group and get em sensitized. “This is VERY important to me” usually works. Any cool events or organizations you can reach out to that will swell our ranks? I’m thinking of going to the Pier at night. Pride is around the corner.
- Visibility - half of this battle will be getting people to notice. I know someone at CNN, who do you know? I never tweet. Don’t we all like to blog, and doesn’t everyone have video on their phones now. How do you feel about a big gay + family(in one sentence) party at McDonald’s? Bet the media will love our press photos. PR strategists are welcome!!!!
- HR Policy - we are going to film a transgender diversity training at the Center. How can you contribute? Are you a non-profit I’ve been to soo many diversity workshops and sensitivity trainings that I am practically a guru? Lend your expertise.
- t shirts- can someone artsy print em, get em donated? Would like for spenders to wear them on spending days.
- letter writers- we need articulate or passionate people to help us get in touch with McDonald’s executives, Human Resources, branch owners, and even politicians, and help pre-negotiate terms contingent upon our spending. We’ve been speaking to a liaison at the gay City Council woman’s office!
We have included Danya Proud, McDonald’s Director of U.S. Communications on this petition. Hopefully this will help create a dialogue with McDonald’s and also national awareness on how to prevent violence against LGBTQ customers in McDonald’s branches.
Yum Brands Restaurants is the LARGEST RESTAURANT CORP in the WORLD. Taco Bell is one of their brands. Jason Ray smith worked for Taco Bell, Stockwell Rd. Bossier City, Louisiana. He was threatened, harassed, & bullied by a fellow employee in front of Mgt. He was told he needed to be taken out to the corn field and have the gay beaten out of him. When he reported it; he was harassed and intimidated by Taco Bell Mgt, District Manager at that. Connecting Rainbows called for a World Wide Boycott of Yum Brand Restaurants. They responded & fired Jason Ray Smith and told him he had to take down his Facebook and Connecting Rainbows pages before he could return to work. He was eventually fired. Lambda Legal is investigating the incident, but our efforts augment their investigation. We are asking that Yum Brand Restaurants apologize to Jason and the LGBT community and all of them stop discriminating against LGBT employees & provide diversity training on sexual orientation and gender identity for all Yum Brand Restaurant employess WORLD WIDE.
